Terms of Service

01. General Provisions

Article 1 (Purpose)
These terms and conditions are for defining basic details regarding conditions and procedures for the use of all services (hereafter reffered to as “the service”) provided by Samyang Corporation (hereafter referred to as “the Company”) on one of its website, samyangspecialty.com.

Article 2 (Effectiveness of Terms and Conditions and Changes therein)

  • ① These terms and conditions become effective upon notification to members via the service or e-mail, etc.

  • ② The Company may change the contents of these terms and conditions, and such changes will come into effect as described in Paragraph 1 above.

Article 3 (Rules outside Terms and Conditions)
Matters not specified in these terms and conditions may be applicable in accordance with the provisions of the Telecommunications Framework Act, the Telecommunications Business Act, and other related laws and regulations.

02. Terms of Service

Article 4 Establishment of Terms of Service

  • ① When a user clicks the "Agree to Terms of Use" button while applying for use of service, it is deemed that he or she agrees to these terms and conditions.

  • ② The Terms of Service is established when the Company approves the user application for use.

  • ③ If the user does not agree with the terms and conditions, he/she may suspend the use of the service. If a user continues using the service even after the terms have been changed, it is deemed that the user agrees to the changes in the terms and conditions.

Article 5 (User Disqualification)
The Company may limit, suspend, or terminate a user’s membership if any of the following applies to the user:

  • 1. In the event he/she used false information for registration

  • 2. In the event his or her use of the service threats lawful electronic transactions, such as disrupting others’ use of the Company or stealing other’s information

  • 3. In the event he/she requests the service for the purpose of disrupting social well-being and/or public morals

  • 4. In the event the requirements for application for use set forth by the company are not met

Article 6 (Application for Use)

  • ① In order to use this service, you must register all user information required in the application form prescribed by the Company for each service.

  • ② All user information written in the Use of Service application form is considered to be real data. Users who do not enter their real name or real information may not receive legal protection and may be restricted from service.

Article 7 (Approval of Application for Use)

  • ① The Company will accept applications for use of service, except when in violation of the provisions of Articles 4, 5, and 6.

  • ② The Company may withhold approval for the following reasons until the issue is resolved:

    • A. If there is no room for service-related facilities;

    • B. In case of technical difficulties;

    • C. If the company deems it necessary.

  • ③ The Company may not accept registration for the following reasons:

    • A. If the user does not have his or her real name or resident registration number;

    • B. If a corporate user doesn’t use a corporation's business registration number;

    • C. In the case of falsely stating required content when applying for use;

    • D. In the case of applying for the service for the purpose of disrupting social well-being and public morals;

    • E. In the case of the application not meeting requirements set by the Company;

    • F. In the case of a child under the age of 14 not obtaining consent of a legal representative, such as a parent.

Article 8 (Change of User's Information)
Users shall manage their information sincerely to use this service, and in the case of changes to user information, the user must make a correction request to the Company, with users being held responsible for any problems that arise from not making said changes.

03. Obligations of Contracting Parties

Article 9 (Obligations of the Company)

  • ① The Company is obligated to provide services continuously and smoothly as stipulated in these terms and conditions.

  • ② The Company will not disclose or distribute users' personal information to others without their consent, and may not use them for any other commercial purposes than service-related business.
    Exceptions to this rule are the following:

    • - In the case of a request from any governmental authority in accordance with related laws such as the Telecommunications Framework Act and the Telecommunications Business Act

    • - In the case of provision of the personal information in such a way that indentity cannot be identified, for it is necessary for statistical records or academic or market research

    • - In the case of sharing any partial information of users with business partners or affiliates in order to apply for scholarships, academia, or for the provision of better services

  • ③ The Company will provide various information when deemed necessary to users during use of service via text messages, e-mails, letters, etc. through a prescribed procedure according to the user's service application.

Article 10 (Obligations of Users)

  • ① The user is responsible for illegal use and management of user information and password etc. input by the user when applying for use of service.

  • ② In the case of illegal use of personal information or other security violations, the user must notify the Company of such incident.

  • ③ User's e-mail address and confirmation number cannot be transferred, leased, or loaned to another person.

  • ④ Users must comply with relevant laws, regulations, matters stipulated in these terms and conditions, service usage guidelines, and precautions.

  • ⑤ Users may not engage in any commercial activities through the service without prior approval of the Company.

04. Service Provision and Use

Article 11 (Category of Services)
These terms and conditions apply to all services provided by the Company, and there may be additional terms and conditions for services that require separate provisions.

Article 12 (Provision of Information)
The Company may provide users with various information necessary for using the service via e-mail or letter mail, etc. If users do not want it, they may refuse to receive information by notifying the Company via telephone.

Article 13 (Transactions with Advertisers)
The Company is not responsible for any loss or damage that may occur as a result of promotional activities posted on this website, or from users participating in advertisers’ such promotional activities through this service.

Article 14 (User Posts)
The Company does not take any civil or criminal responsibility for anything posted, published, e-mailed, or otherwise transmitted by the user through this service. Posts may be deleted without prior notice for the following reasons:

  • ① In the case of content that slanders other users or others, infringes on privacy, or damages reputation by slander

  • ② In the case of it interfering with or is likely to interfere with the stable operation of the service

  • ③ In the case of content recognized as being related to criminal activity

  • ④ In the case of content that infringes on the intellectual property rights of the Company or the intellectual property rights of others

  • ⑤ In the case it is determined to be in violation of other related laws

Article 15 (Rights and Responsibilities for Posts)

  • ① Copyrights for all posts on this site belong to the Company unless there is a separate expression of intention between the parties in advance.

  • ② Posts are protected by the company, and it is prohibited to use or quote others’ posts on other websites without the Company's permission.

  • ③ This product information is published for your consideration and independent verification. Samyang Corporation accepts no liability for its accuracy or completeness.
    We may change this information at any time. The promoted applicability of label claims and the regulatory and intellectual property status of our ingredients which are based on the Republic of Korea and U.S. FDA can vary by each jurisdiction. You are responsible to obtain your own advice regarding all legal and regulatory aspects of our ingredients and their usage in your own products to determine suitability for their particular purposes, claims, freedom to operate, labelling or specific applications in any particular jurisdiction

Article 16 (Use of Service Hours)
As a rule, the Company provides services 24 hours a day, 7 days a week, unless there are business or technical obstacles, or other special circumstances. The service may be suspended or the access to the service may be limited in the following events: other than the event that the Company is scheduled for a routine inspection, a problem in the use of service arises due to facility failure, service congestion, telecommunication service suspension by the key telecommunication service provider according to the Telecommunication Business Act, or a force majeure such as natural disasters. All or part of the use may be restricted.

Article 17 (Responsibility for use of Service)
Users are prohibited from using the service to engage in illegal sales activities, including, in particular, hacking, money-making advertisements, commercial activities through obscene sites, and illegal distribution of commercial S/W. The Company shall not be liable for any damages or loss, or any consequences caused by violation of such prohibition, including loss of business activities, any actions from law enforcement, etc.

05. Miscellaneous

Article 18 (Compensation for Damages)
The Company shall not be liable or responsible for any damages or loss incurred by users in connection with the use of the service.

Article 19 (Disclaimer)

  • ① The Company is exempt from liability for service provision if it is unable to provide the service due to force majeure including natural disasters.

  • ② The Company is exempt from liability for damages caused by the user's negligence in managing and using their ID and confirmation number, or for its illegal use by a third party.

  • ③ The Company shall not be responsible or liable for any damage caused to users due to the information obtained from any webpage provided by the Company or answers to inquiries from certain experts.

  • ④ The Company is exempt from liability for damages caused by the user's failure to obtain any benefits expected by such users from the Company's service, or from the materials provided by the Company.

  • ⑤ The Company shall not be liable or responsible for any contents posted by service users, including the reliability and accuracy of their information, data, or facts.

Article 20 (Jurisdiction)
If a lawsuit is filed in relation to the use of the service, the court having jurisdiction over the Company’s principal place of business shall be the competent court.
